TO BE HELD ON MONDAY, SEPTEMBER 24, 2007, AT 7:00 P.M.

IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING

AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance.

2. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).

a. Consider appointment to certain Boards and Commissions.

b. Consider a request for a refund of $166.08 plus interest to taxpayer for 2006 personal property taxes erroneously assessed.

3. Receive a report from viewers and set a public hearing date of October 22, 2007 for a

request from Acend 2002, LLC, to vacate a 15 foot alley along the southwest side of Lots

7-15 of the C.M. Meadows plat, Tax Map No. 37 in the vicinity of Third Street.

d. Consider Community Development Block Grant (CDBG) for the Jackson & 3rd Street

Project.

4. Second consideration/approval of an ordinance for a conditional use permit to allow a six-

unit townhouse building (shown as Lots 11-16 on the New Townhouse Development

preliminary plat) to be relieved from the requirement of City Code Section 98-138 which

stipulates that all residential units must have a public street frontage.

3. Planning Matters:

a. Receive a report and recommendation from the Planning Commission and consider adopting revisions to City Code Chapter 98 Article 2, Division 6, Subdivision I “Floodplain Overlay District” Flood Plain Ordinance that will become effective immediately.”

4. Consider Introduction of the Following Ordinances:

1. Consider an ordinance appropriating certain capital reserve funds for the purpose of

reconstructing the tennis courts at Ridgeview Park and for building improvements to the

Rosenwald Community Center.

2. Consider an ordinance amending Section 82-222.1 of the Code of this city requiring the

use of helmets for the operation of bicycles and mopeds in the City of Waynesboro.

5. Consider Approving the Following Resolutions:

1. Setting the Personal Property Tax Relief Act (PPTRA) rate of relief for tax year 2007.

b. Authorizing a 2008 Virginia Enterprise Zone designation.

6. Consider adopting a proclamation declaring Thursday, September 27, 2007 as Kiwanis

Community Service Day.
