AGENDA FOR WAYNESBORO CITY COUNCIL TO BE HELD ON MONDAY, MARCH 26, 2007, AT 7:00 P.M. IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance

2. Presentation of Virginia Main Street Milestone Award for 10,000 Volunteer Hours.

3. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).

a. Approval of minutes of the previous meetings (3-12-07 Regular Meeting; 3-19-07 Work Session) and dispensing with reading of minutes.

b. Second consideration/adoption of an ordinance appropriating $6,003.00 to the General Fund Operating from federal revenues received for the reimbursement of prior fiscal year expenditures for the fiscal year ending June 30, 2007. (Building Improvements at Wayne Hills Elementary for HAVA Compliance)

c. Second consideration/adoption of an ordinance appropriating $368.00 to the General Fund Operating for the fiscal year ending June 30, 2007. (Donation to P&R for planters at the front door of the Waynesboro Public Library)

d. Second consideration/adoption of an ordinance appropriating investment income earned on the 2005 General Obligation Bond Proceeds and the 2006 Literary Loan Anticipation Note Proceeds from the General Fund to the School Special Projects Fund for the fiscal year ending June 30, 2007. ($764,461.12 – KCMS Renovation Project)

e. Schedule a Public Hearing for Monday, April 9, 2007, to consider transferring ownership of the Wayne Theatre building and a portion of the adjoining parking lot to the Waynesboro Economic Development Authority.

f. Cancellation of April 5, 2007, Budget Work Session.

g. Appoint Sharon Hiserman and Ron Hiserman to the Waynesboro Disability Services Board to fill the unexpired terms of Erica Lounsberry (Term Expiring 8/31/2009) and Mack Quillen (Term Expiring 8/31/2010).

h. Approval of street closures for the 2007 Tour of Virginia.

4. Planning Matters:

a. Hold a Public Hearing to consider the request of Brower Limited Partnership, R. Francis Brower, owner, to close and vacate a 10’ alley between 1022 W. Main Street and 1030 W. Main Street in order to expand an existing business operation currently located at 1022 W. Main Street, Waynesboro, Virginia.

b. Receive the report and recommendation of the Planning Commission regarding the request of Tina Tinsley, Representative for Balzer and Associates, contract purchaser, for Gayle S. Trevillian (McClung Printing Inc.), owner, for a Conditional Use Permit to expand a non-conforming use in a C-2 (General Business) District on property known by street address as 550 Commerce Avenue, Waynesboro, Virginia, legally described as Tax Map/Parcel 47-1-33-9-24, the Comprehensive Plan designation being Mixed Use.

c. Receive the report and recommendation of the Planning Commission regarding the request of Andrew Boninti, contract purchaser, for Carflo Farm LLC, c/o Mae Grove Andrews, owner, for a rezoning from RA-1 (Single Family District) to C-2 (General Business District) for future commercial development on property legally described at Tax Map/Parcel 41-3-112, approximately 1.8 acres in the vicinity of Tiffany Drive, Waynesboro, Virginia.

5. Presentation of the School Board’s FY08 Budget.

6. Presentation by Michael Dowell, Executive Director of the Artisan Center of Virginia, regarding activities at the ACV and presentation of their new strategic plan.

7. Presentation by Lianne Crookshanks, Chair of the Greater Augusta Regional Tourism Board, regarding the Board’s new marketing portfolio.

8. Approval of the use of Contingency Fund to pay for the broadcast of the FY08 Budget Work Sessions. ($3,300.00).

9. Consider introduction of the following ordinances:

a. Appropriating $4,730.00 from the sale of surplus property to the General Fund Operating for the fiscal year ending June 30, 2007. (Auction services and fencing of impound lot)

b. Appropriating a $3,761.00 donation from the Kiwanis Club to the Department of Parks and Recreation Undesignated Reserve for Programs to the General Fund Operating for the fiscal year ending June 30, 2007. (Donation from proceeds of Summer Extravaganza 2006)

c. Appropriating $52,480.00 in Categorical State Wireless E911 Funds to the Emergency Management Department’s EOC Division Fulltime Wages Budget and re-appropriating $52,480.00 appropriated to Public Safety by Ordinance 2006-77 to the General Fund Operating for the fiscal year ending June 30, 2007. (Wireless E911 Funds)

d. Appropriating $63,250.00 from insurance proceeds and the Unreserved Fund Balance of the Sewer Fund for the purchase of equipment for the fiscal year ending June 30, 2007. (Backhoe Purchase)

e. Appropriating $149.00 in additional State Categorical DMV Animal Friendly Funds to the General Fund Operating for the fiscal year ending June 30, 2007. (Payment to the SPCA)

f. Appropriating $1,265.00 in additional State Categorical $4-For-Life Funds to the General Fund Operating for the fiscal year ending June 30, 2007. (Waynesboro First Aid Crew Contribution)

g. Appropriating $2,800.00 in State Categorical Revenues from the Virginia Commission of the Arts for elementary classroom instructional materials for the fiscal year ending June 30, 2007. (Teacher Incentive Grants)

h. Appropriating $90,000.00 from the General Fund Unreserved Fund Balance for the fiscal year ending June 30, 2007. (Increased local share of CSA funding/DSS)

Consider holding a Closed Meeting under Section 2.2-3711 of the Freedom of Information Act, Code of Virginia, 1950, as amended, (a) (3) for discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body; specifically for discussion of the disposition of the Waynesboro Health Department property at 1300 13th Street, Waynesboro, Virginia.
