AGENDA FOR WAYNESBORO CITY COUNCIL TO BE HELD ON MONDAY, MAY 14, 2007, AT 7:00 P.M. IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance

2. Presentation of two awards from the Virginia Public Library Director’s Association.

3. Recognition of the City Engineer, Mrs. Kimberly L. Cameron, P.E., by Jim Echols of the Department of Conservation and Recreation regarding the City’s E&S Program.

4. Proclamations/Resolutions:

a. Public Works Day 2007

b. NAIW Week 2007

c. Mental Health Month 2007

d. Business Appreciation Week 2007

5. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).

a. Approval of minutes.

b. Second consideration/adoption of ordinance establishing a reserve in the amount of $20,000.00 in the General Fund for support of the City’s PEG Channel utilization for the fiscal year ending June 30, 2007. (Equipment Grant received from ntelos Media, Inc.)

c. Second consideration/adoption of ordinance appropriating a $50.00 donation to the CSA Fund for transfer to the Special Welfare Account for the fiscal year ending June 30, 2007. (Benefit of Specific Foster Care Children)

d. Second consideration/adoption of ordinance appropriating a $50.00 donation to the DARE Program and $95.00 in court-ordered restitution to the General Fund for the fiscal year ending June 30, 2007.

e. Approval of request from Dr. Glen A. Holman, Pastor of First Presbyterian Church, for closure of 11th Street from Wayne Avenue to Chestnut Avenue for a live auction on Saturday, June 2, 2007 from 8:00 A.M. until 12:00 P.M.

f. Reappointment of Mr. James Mahoney and Mr. Thomas Ramsburg to second three-year terms on the Valley Community Services Board beginning on July 1, 2007, and ending on June 30, 2010.

g. Approval of one Personal Property Tax refund.

h. Approval of a request from D. W. Garber for amplified music at an end-of-school pool party at his residence located at 104 Pelham Inlet, Waynesboro, Virginia, on Friday, June 8, 2007, in the afternoon.

6. Planning Matters:

a. Hold a Joint Public Hearing on the request of the Planning Commission to consider amending City Code Section 98-565, “Procedures for Proffering Conditions to Zoning District Regulations”.

b. Hold a Joint Public Hearing on the request of Rutherford Construction, agent, for Edgeworth, LLC, owner, for Preliminary Subdivision Plat approval of property described legally as Tax Map/Parcel 62-1-5, 23.975 acres located on Lyndhurst Road, Waynesboro, Virginia, presently zoned RB-2 (Multiple Dwelling District), for a 90-lot subdivision to include 19 single-family lots and 71 townhomes.

c. Hold a Joint Public Hearing on request of Rutherford Construction, agent, for Edgeworth, LLC, owner, for a Conditional Use Permit to allow one 10-unit townhome building to be accessed by an access easement and to not have frontage on a public street in an RB-2 (Multiple Dwelling) District on property known by an unnumbered street address on Lyndhurst Road, Waynesboro, Virginia, legally described as Tax Map/Parcel 62-1-5, the Comprehensive Plan designation being Large Lot Single Family.

d. Hold a Joint Public Hearing on request of Doug Huffman, applicant and lessee for CPR Properties, LLC, owner, for a Conditional Use Permit to expand a current use to include automobile sales at an auto repair shop in a C-2 (General Business) District on property known by street address as 200 N. Bayard Avenue, Waynesboro, Virginia, legally described as Tax Map/Parcel 46-1-44, Lots 19-21, BCMM&L Co. Plat, the Comprehensive Plan designation being Mixed Use District.

e. Hold a Public Hearing on the request of the City of Waynesboro, Virginia, to close and vacate a portion of the 10’ alley adjacent to the Wayne Theatre located between lots 30 & 31, Estill Plat, W. Main Street, Waynesboro, Virginia.


7. Introduction of the following ordinances:

a. Imposing taxes for the calendar year 2007 on property and persons.

b. Annual appropriation ordinance for the year ending June 30, 2008.

c. Adopting revisions to Chapter 90, “Vegetation,” of the Code of the City of Waynesboro, Virginia.

d. Re-appropriating $446,495.00 of FY07 Correction and Detention Funds and $16,935.00 from the Health Department Reserve to the General Fund Unreserved Fund Balance for transfer to a capital reserve in the Special Projects Fund in the amount of $163,430.00 and $300,000.00 for Wayne Theatre building physical repairs for the fiscal year ending June 30, 2007.

e. Appropriating $300.00 in asset forfeiture revenues to the State Asset Forfeiture Fund and the General Fund for the fiscal year ending June 30, 2007.

f. Appropriating $574,203.00 in owner’s capital held in the Local Government Investment Pool in the name of the Augusta County Regional Landfill to the City’s Landfill Post-Closure Fund for the fiscal year ending June 30, 2007.

g. Appropriating $11,191.00 in State categorical revenues from a DMV Mini-Grant to the Police Patrol Division in the General Fund for the fiscal year ending June 30, 2007.

h. Appropriating $14,384.00 in Federal categorical revenues from a Terrorism Prevention Grant to the Police Department in the General Fund for the fiscal year ending June 30, 2007.

i. Appropriating $2,883.00 in insurance reimbursement proceeds to the Fleet Maintenance Fund for the fiscal year ending June 30, 2007.

8. Consideration of resolution adopting the FY08 – FY12 Capital Improvements Plan.
