AGENDA FOR WAYNESBORO CITY COUNCIL TO BE HELD ON MONDAY, APRIL 9, 2007, AT 7:00 P.M. IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance

2. Resolution/Waynesboro High School Boys Basketball Team

3. Presentation of Better Model of Development Award by John Eckman, Executive Director of the Valley Conservation Council.

4. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).

a. Approval of minutes of the previous meetings (3-19-07 Work Session; 3-26-07 Work Session; 4-2-07 Work Session) and dispensing with reading of minutes.

b. Second consideration/adoption of an ordinance closing and vacating a 10’ alley between 1022 W. Main Street and 1030 W. Main Street in order to expand an existing business operation currently located at 1022 W. Main Street, Waynesboro, Virginia, on the request of Brower Limited Partnership, R. Francis Brower.

c. Second consideration/adoption of an ordinance granting a Conditional Use Permit to Tina Tinsley, Representative for Balzer and Associates, contract purchaser, for Gayle S. Trevillian (McClung Printing Inc.), owner, to expand a non-conforming use in a C-2 (General Business) District on property known by street address as 550 Commerce Avenue, Waynesboro, Virginia, legally described as Tax Map/Parcel 47-1-33-9-24, the Comprehensive Plan designation being Mixed Use.

d. Second consideration/adoption of an ordinance rezoning from RA-1 (Single Family District) to C-2 (General Business District) for future commercial development property legally described at Tax Map/Parcel 41-3-112, approximately 1.8 acres in the vicinity of Tiffany Drive, Waynesboro, Virginia, on the request of Andrew Boninti, contract purchaser, for Carflo Farm LLC, c/o Mae Grove Andrews, owner.

e. Second consideration/adoption of an ordinance appropriating $4,730.00 from the sale of surplus property to the General Fund Operating for the fiscal year ending June 30, 2007. (Auction services and fencing of impound lot)

f. Second consideration/adoption of an ordinance appropriating a $3,761.00 donation from the Kiwanis Club to the Department of Parks and Recreation Undesignated Reserve for Programs to the General Fund Operating for the fiscal year ending June 30, 2007. (Donation from proceeds of Summer Extravaganza 2006)

g. Second consideration/adoption of an ordinance appropriating $52,480.00 in Categorical State Wireless E911 Funds to the Emergency Management Department’s EOC Division Fulltime Wages Budget and re-appropriating $52,480.00 appropriated to Public Safety by Ordinance 2006-77 to the General Fund Operating for the fiscal year ending June 30, 2007. (Wireless E911 Funds)

h. Second consideration/adoption of an ordinance appropriating $63,250.00 from insurance proceeds and the Unreserved Fund Balance of the Sewer Fund for the purchase of equipment for the fiscal year ending June 30, 2007. (Backhoe Purchase)

i. Second consideration/adoption of an ordinance appropriating $149.00 in additional State Categorical DMV Animal Friendly Funds to the General Fund Operating for the fiscal year ending June 30, 2007. (Payment to the SPCA)

j. Second consideration/adoption of an ordinance appropriating $1,265.00 in additional State Categorical $4-For-Life Funds to the General Fund Operating for the fiscal year ending June 30, 2007. (Waynesboro First Aid Crew Contribution)

k. Second consideration/adoption of an ordinance appropriating $2,800.00 in State Categorical Revenues from the Virginia Commission of the Arts for elementary classroom instructional materials for the fiscal year ending June 30, 2007. (Teacher Incentive Grants)

l. Second consideration/adoption of an ordinance appropriating $90,000.00 from the General Fund Unreserved Fund Balance for the fiscal year ending June 30, 2007. (Increased local share of CSA funding/DSS)

m. Reappointment of Dr. Sandra Curry to the Blue Ridge Community College Board.

n. Approval of a 2005 & a 2006 Real Estate Tax refund.

5. Hold a Public Hearing to consider transferring ownership of the Wayne Theatre building and portions of adjoining City owned property to the Waynesboro Economic Development Authority and consideration of a resolution directing the City Manager to affect the transfer.

6. Presentation by Jeff Fife and Jeff Hersh, Waynesboro Family YMCA, regarding the City of Waynesboro Employee Wellness Pilot Program.

7. Consider the request of William B. Stringham, dba The Federal Building, LLC, for a dance hall permit at 305 East Main Street, Waynesboro, Virginia.

8. Appoint Viewers to consider the request of the City of Waynesboro, Virginia, to close and vacate a portion of the 10’ alley adjacent to the Wayne Theatre located between lots 30 & 31, Estill Plat, W. Main Street, Waynesboro, Virginia.

Consider holding a Closed Meeting under Section 2.2-3711 of the Freedom of Information Act, Code of Virginia, 1950, as amended, (a) (3) for discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body; specifically for discussion of the disposition of the Waynesboro Health Department property at 1300 13th Street, Waynesboro, Virginia.
