IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING

AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance

2. Consent Agenda (any item placed on the consent agenda shall be removed and taken up as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).

a. Consider the request from The Office of Tourism and Office on Youth to close Main Street, from Arch to McElroy, with Arch Street remaining open, for the “Rock the Block” substance-free community event, on Saturday, September 15, 2007 from 3:00 pm to 10:00 pm.

b. Consider the request from Anita Weaver, Weavers Sells Auctioneer, 327 Howardsville Turnpike, Stuarts Draft, VA, to close Elm Street, adjacent to 501 King Avenue, on Saturday, September 15, 2007, from 7:00 a.m. to 3:00 p.m., for purposes of holding an auction.

c. Second Consideration/Adoption of an Ordinance Increasing Landfill Tipping Fees to $45 per ton.

d. Consider holding a public hearing at the regular business meeting of City Council on September 10, 2007, on the City’s application to the Virginia Department of Housing and Community Development for an Enterprise Zone designation.

3. Planning Matters:

a. Receive a report and recommendation from the Planning Commission on the request of Brasil W. Hamrick, agent, for Scott J. Hudson, owner, for preliminary subdivision plat approval to subdivide a 2.571-acre tract located on the south side of White Bridge Road at its intersection with Guilford Lane in order to create a proposed 16-lot residential development. The subject property is known by City Tax Map #24-1 -Dl, #24-3-20B & 24-1-B.

2. Receive a report and recommendation from the Planning Commission on the request of Brasil W. Hamrick, agent for Scott J. Hudson, owner, for a conditional use permit to allow a six-unit townhouse building (shown as Lots 11-16 on the New Townhouse Development preliminary plat) to be relieved from the requirement of City Code Section 98-138 which stipulates that all residential units must have public street frontage. This request is made in connection with the proposed 2.571-acre, 16-lot sub-division. The subject property is located on the south side of White Bridge Road at its inter-section with Guilford Lane and is known by City Tax Map #24-1-D1, #24-3-20B & #24-1-B.

c. Request of the City Zoning Administrator and Building Official for proposed amendments to City Code Chapter 98, Zoning, Section 98-332 Et seq., Floodplain Overlay District, related to the updated Flood Insurance Rate Map (FIRM).

4. Consider petitioning the Judge of the Circuit Court to hold a referendum on certain Capital Improvement Projects.

5. Consider an ordinance appropriating certain capital reserve funds for the purpose of reconstructing the tennis courts at Ridgeview Park and for building improvements to the Rosenwald Community Center.

6. Hold a Public Hearing to receive public comment on a proposed ordinance authorizing the issuance of General Obligation School Bonds in a maximum principal amount not to exceed $7,500,000 to refund an outstanding interim school financing.

7. Consider introducing an ordinance authorizing the issuance of General Obligation School Bonds in a maximum principal amount not to exceed $7,500,000 to refund an outstanding interim school financing.

8. Consider request for partial refund of 2004, 2005, 2006 and 2007 Real Estate Tax paid in error by property owner.

9. Consider making appointments to Boards and Commissions.
