TO BE HELD ON MONDAY, JUNE 9, 2008, AT 7:00 P.M.
IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING
AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance.
2. Consent Agenda (any item placed on the consent agenda shall be removed and considered as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).
a) Approval of Amended Minutes from the April 21 Budget Work Session, Minutes from the April 24 Budget Work Session and the April 28 Regular Business Meeting, and dispense with the reading of the Minutes.
b) Consider approving a request from the Commissioner of Revenue to refund personal property taxes to an individual in the amounts of $28.08 and $11.37 that were paid in error.
c) Second consideration/adoption of the Annual Appropriation Bill of the City of Waynesboro, Virginia, appropriating sums of money for all necessary expenditures of the City for Fiscal Year Ending June 30, 2009, to prescribe the terms, conditions, and provision with respect to the expenditure categories of appropriation and their payment, and to repeal ordinances wholly in conflict with this ordinance, and all ordinances inconsistent with this ordinance to the extent of such inconsistency.
d) Second Consideration/Adoption of an Ordinance Appropriating a Community Gang Collaboration Grant to the Youth and Family Services Operating Fund in the Amount of $200,000 for Expenditures Related to Gang Prevention Programs for the Fiscal Year Ending June 30, 2008.
e) Second Consideration/Adoption of an Ordinance Appropriating Governor’s Youth Community Service and Civic Engagement Program Funds (GOSAP) to the Youth and Family Services Operating Fund in the Amount of $5,000 for Expenditures Related to the Augusta County For Youth Corps Program for the Fiscal Year Ending June 30, 2008.
f) Second Consideration/Adoption of an Ordinance Appropriating Governor’s Youth Community Service and Civic Engagement Program Funds (GOSAP) to the Youth and Family Services Operating Fund in the Amount of $5,000 for Expenditures Related to the Staunton After School Youth Power Program for the Fiscal Year Ending June 30, 2008.
g) Second Consideration/Adoption of an Ordinance Appropriating Governor’s Youth Community Service and Civic Engagement Program Funds (GOSAP) to the Youth and Family Services Operating Fund in the Amount of $5,000 for Expenditures Related to the Summer Youth Power Program for the Fiscal Year Ending June 30, 2008.
h) Second Consideration/Adoption of an Ordinance Appropriating a Healthy Marriage and Stable Families Grant to the Youth and Family Services Operating Fund in the Amount of $22,482 for Expenditures Related to the Start of the Parent Project Program for the Fiscal Year Ending June 30, 2008.
i) Second Consideration/Adoption of an Ordinance Appropriating a Justice Assistance Grant to the Youth and Family Services Operating Fund in the Amount of $13,262 for Expenditures Related to the SAW Gang Prevention Initiative for the Fiscal Year Ending June 30, 2008.
j) Second Consideration/Adoption of an Ordinance Appropriating a Justice Assistance Grant to the Youth and Family Services Operating Fund in the Amount of $15,588 for Expenditures Related to the SAW Gang Prevention Initiative for the Fiscal Year Ending June 30, 2008.
k) Second Consideration/Adoption of an Ordinance Appropriating $40,000 from the Youth and Family Programs Unreserved Fund Balance for Expenditures Related to a Pre-Employment program for Youth Funded in Fund 216 (Youth Corp) and for Program Costs for Teen Pregnancy Prevention Funded in Fund 218 (Teen Pregnancy) for the Fiscal Year Ending June 30, 2008.
l) Second Consideration/Adoption of an Ordinance Appropriating $1,708 from a State Litter Grant to the General Fund Operating Fund for Expenditures Related to the FY08 Litter Program for the Fiscal Year Ending June 30, 2008.
m) Second Consideration/Adoption of an Ordinance Appropriating $53,699 from the Water Fund Unreserved Fund Balance for Expenditures Related to Water Improvement Projects on Kirby Avenue and Gardner Street, to Increase Funding for the Meter Replacement Program and to Appropriate Insurance Proceeds Received for Damages to a Fire Hydrant on Rosser Avenue for the Fiscal Year Ending June 30, 2008.
n) Second Consideration/Adoption of an Ordinance Appropriating $125,775 from 2007 GO Bond Proceeds FBO Sewer Line Projects and $31,538 from the Sewer Fund Unreserved Fund Balance for (1) Expenditures Related to Sewer Improvement Projects for Oak Hill Phase 2 and (2) Equipment Purchases, Respectively, for the Fiscal Year Ending June 30, 2008.
o) Second Consideration/Adoption of an Ordinance Appropriating $120,756 from the Sale of Surplus Equipment and $41,711 from Rev. From Use of Equipment/Rental VDOT Reimbursable for Expenditures Related to the Purchase of Mowing Equipment, Heavy Equipment, Motor Vehicles, Police Vehicle Equipment and Auction Services for the Fiscal Year Ending June 30, 2008.
p) Second Consideration/Adoption of an Ordinance Granting a Conditional Use Permit to allow an 18-Unit townhouse development to be accessed by private drive and to not have frontage on a public street, in connection with a proposed residential development to be known as “DAVIS COMMONS,” located between Winchester Avenue and Forest Avenue, Legally Described as Block 208, Lots 1, 2, 5, 6, 7, 8, ½ Of Lot 9, and part of vacated alley, Shenandoah Heights, Waynesboro, VA.
q) Second Consideration/Adoption of an Ordinance Amending and Recodifying Chapter 26, Cemeteries, of the Waynesboro City Code.
3. Planning Matters:
a) Hold a Joint Public Hearing with the Planning Commission to receive public comment on the application of Charlottesville League of Therapists Inc., d/b/a Augusta League of Therapists, contract purchasers, for a Conditional Use Permit requesting a reduction of four parking spaces from the required fifteen at 336 South Wayne Avenue, legally known as Block 21, Lots 10, 11, and 12, Waynesboro Co. Adt., Waynesboro, Virginia.
b) Hold a Public Hearing to receive public comment on, and consider a proposed draft of the Land Use Guide, Land Use Map, and associated report of the City’s Comprehensive Plan Update.
4. Hold a Public Hearing to receive public comment on an application by the Wayne Theatre Alliance for exemption from real estate and personal property taxes for the Wayne Theatre Alliance, Inc.
5. Consider adopting a resolution supporting action by the Governor and the General Assembly to address transportation funding.
6. Consider introducing the following ordinances:
a) Appropriating $41,954 from the General Fund Unreserved Fund Balance to a Designated Reserve for the Benefit of the Waynesboro Health Department for the Fiscal Year Ending June 30, 2008.
b) Re-appropriating Funds for Certain Fiscal Year 2008 Expenditures, Previously Appropriated in Accordance with Ordinance 2007-49 City of Waynesboro Annual Appropriation Ordinance and Subsequent Budget Amendment Ordinance 2008-21 to a Reserve for Fiscal Year 2008 Encumbrances for the Fiscal Year Ending June 30, 2008.
c) Appropriating $16,844 from 2007 GO Bond Proceeds for the Benefit of Sewer Line Projects and Re-Appropriating General Fund Engineering Division Wages and Benefits in the Amount of $16,844 to the Sewer Fund Toward the Purchase Price of Currently Rented Equipment for the Fiscal Year Ending June 30, 2008.

8. Communication, Correspondence and Calendar.
9. Consider holding a Closed Session pursuant to § 2.2-3711 of the Freedom of Information Act, Code of Virginia, 1950, as amended, (a) (7), regarding consultation with legal counsel and briefings by staff members or consultants pertaining to actual or probable litigation, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the public body, more specifically, to consult with legal counsel regarding the matter of Rothacker v. City of Waynesboro.
