REVISED AGENDA FOR WAYNESBORO CITY COUNCIL
REGULAR BUSINESS MEETING
TO BE HELD ON MONDAY, JULY 28, 2008, AT 7:00 P.M.
IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING
AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.


1.Call to Order/Pledge of Allegiance.
2.Consent Agenda (any item placed on the consent agenda shall be removed and considered as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).
a.Approval of Minutes from the June 23, 2008 Regular Business Meeting and the July 1 Organizational Meeting, and dispense with the reading of the Minutes.
3.Receive presentation of Friendly Cities Proclamation from Wanzhou, China, presented by Mr. Tom Sikes.
4.Boards and Commissions Update: Receive a presentation by Brenda Sasser, Interim Executive Director, on the Valley Community Services Board’s performance contract.
5.Planning Matters:
a.Receive a report and recommendation from the Planning Commission and consider introducing an ordinance regarding the request of Stacy A. Comer and Chastity C. Comer. Lessees, for a Conditional Use Permit to allow operation of an auto body shop in a C-2 General Business District on property located at 903-A East Main Street, Waynesboro, Virginia, City Tax Map Parcel 56-2-4.

b.Receive a report and recommendation from the Planning Commission and consider introducing an ordinance regarding the request of Evan Wyatt of Greenway Engineering, Inc., for a zoning text amendment to amend City Code Sections 98-291 and 98-294(1)(b) to allow for Planned Unit Development Districts within Industrial Zoning Districts and add consideration of environmental conditions in adjusting the open space requirements therein.

c.Consider a resolution at the request of Michael D. Smith, agent for Waynesboro TC, LLC granting a waiver of subdivision ordinance Section 74-40 (e) which requires that all lots must front on a public street for a proposed parcel containing a storm water detention pond at the Waynesboro Town Center such parcel indicated on the Final Subdivision Plat of Parcel “B-1-J” Waynesboro Town Center produced by Fred Edward Willman, June 26, 2008.


6.Hold a Public Hearing to receive public comment regarding an ordinance amending Section 82-222.1 of the Code of Waynesboro requiring the use of helmets for the operation of bicycles and adding Section 82-222.2 requiring the use of helmets for the operation of mopeds in the City of Waynesboro.
7.Consider introducing the following ordinances:
a.Amending Section 82-222.1 of the Code of Waynesboro requiring the use of helmets for the operation of bicycles and adding Section 82-222.2 requiring the use of helmets for the operation of mopeds in the City of Waynesboro.
b.Appropriating Teaching American History grant funds in the amount of $156,940 to the Secondary Central Office and District Wide Central Office funds for the Fiscal Year ending June 30, 2009.
8.Citizen Comment Period.
9.Communication, Correspondence and Calendar.
10.CLOSED SESSION: Under Sections 2.2-3711 (a)(3) and(7) of the Freedom of Information Act, Code of Virginia, 1950, as amended, regarding discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body, and consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advice by such counsel; more specifically, to consult with legal counsel regarding acquisition of property for the City Greenway Project.
11.Adjourn.
