TO BE HELD ON MONDAY, MARCH 24, 2008, AT 7:00 P.M.

IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING

AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order/Pledge of Allegiance.
2. Consent Agenda (any item placed on the consent agenda shall be removed and considered as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).
1. Approval of Minutes for the March 3 Work Session and the March 10 Business Meeting, and dispense with the reading of the Minutes.
2. Consider a request for a refund of 2005, 2006, and 2007 real estate taxes in the amount of $175.66 plus interest for corrections relating to square footage calculations of a finished basement.
3. Consider a request for a refund of 2007 personal property taxes in the amount of $190.65 plus interest, on a 2003 Mitsubishi as the PPTRA was not granted due to a filing error.
4. Consider a request from New Covenant Motorcycle Ministry to close the parking lot in Constitution Park for the Valley Bike Fest II, on Sunday, September 21, 2008, from 10:00 a.m. until the close of the park.

5. Second consideration/adoption of an ordinance amending the General, Youth, and Family Services, Water, Sewer, Landfill Post-Closure, Stormwater, Special Projects, and Fleet Maintenance Fund Budgets in an Aggregate Amount of $34,735,794 for the Fiscal Year ending June 30, 2008.

3. Submission of the School Board’s Recommended Fiscal Year 2009 Budget.

4. Planning Matters:

1. Receive a report and recommendation from the Planning Commission and consider introducing an ordinance on the request of Drumeller Properties LLC to rezone a property located at 412 Cedar Avenue and known by Tax Map 44(4), Lots 27, 28 and 29, Block 27, West Waynesboro Land Co., from RB-4 Mixed Density Dwelling District to C-1 Local Business District with proffers.

2. Receive a report and recommendation from the Planning Commission and consider introducing an ordinance on the request of James H. and Kay L. Heafner, to amend the City Zoning Ordinance, Code Section 98-250.4B to include Bed and Breakfast Establishment as a permitted conditional use in the RA-3 District Single-Family District.
3. Receive a report and recommendation from the Planning Commission and consider introducing an ordinance on the request of James H. and Kay L. Heafner for a conditional use permit to operate a Bed and Breakfast Establishment in the RA-3 Single-Family District at a property located at 607 Oak Avenue, Waynesboro, known by Tax Map No. 44 4 5-4, Block 5, Lots 4, 5, and 6.
4. Appoint viewers to consider the request of South River, Incorporated, to close and vacate a portion of Race Avenue and 13th Street, adjacent to Tax Parcel 55-1-15-31 and 55-2-A, and to close and vacate a portion of 12th Street and a 20 foot alley, adjacent to Tax Parcel 55-1-14-1 and 55-2-A, to allow for the consolidation of all parcels owned by South River Inc., providing for greater flexibility in design for the adaptive reuse of this site as a Planned Unit Development.

5. Consider adopting the revised City Employee Handbook and Compensation Philosophy.

6. Consider adopting a Reimbursement Resolution in the amount of $3.7 million for an upcoming Bond Issue related to sewer CIP projects not funded through DEQ WRLF.
7. Receive presentation by City Attorney and Building and Zoning Administrator regarding updates to the City noise ordinance.
8. Consider setting a public hearing to receive public comment on the adoption of an ordinance authorizing the donation of unclaimed bicycles, electric power-assisted bicycles, mopeds, and electric personal assistive mobility devices.
9. Consider introducing the following ordinances:
1. Appropriating $9,090.00 to the School’s Project Graduation Grant from the Secondary Classroom Instructional Purchased Services.
2. Appropriating $4,140.00 to the School’s Teacher Incentive Grant Fund from the Virginia Commission for the Arts.
3. Appropriating $2,500.00 to the Office on Youth for the purchase of multimedia equipment, from the Gannett Foundation mini grant.
10. Consider adopting a resolution approving a Community Action Agency Memorandum of Understanding.
11. Consider approving the following appointments:
1. Appointment to the Cultural Commission, filling an unexpired four-year term of January 8, 2007 to August 31, 2009.
2. Appointment to the Artisans Center of Virginia Board of Trustees, filling a three-year term of July 1, 2007 through June 30, 2010.
12. Citizen Comment Period.
13. Communication, Correspondence and Calendar.
14. Consider holding a Closed Session pursuant to § 2.2-3711 of the Freedom of Information Act, Code of Virginia, 1950, as amended, (a) (7), regarding consultation with legal counsel employed or retained by a public body regarding specific legal matters requiring the provision of legal advice by such counsel, more specifically, to discuss legal issues with regard to televising public forums on the City government channel.
15. Adjourn.
