AGENDA FOR WAYNESBORO CITY COUNCIL
TO BE HELD ON MONDAY, MARCH 10, 2008, AT 7:00 P.M.
IN THE COUNCIL CHAMBERS, CHARLES T. YANCEY MUNICIPAL BUILDING
AT 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.
1. Call to Order/Pledge of Allegiance.
2. Consent Agenda (any item placed on the consent agenda shall be removed and considered as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).
1. Approval of Minutes from the September 4, 2007 Business Meeting, February 4, 2008 Amended Minutes, and the February 25, 2008 Business Meeting, and dispense with the reading of the Minutes.
2. Consider a request for a refund of $780.30, plus interest, for 2007 personal property tax on a vehicle that was paid to Augusta County.
3. Consider a request from the Coordinator of Summer of Praise 2008 to use the Ridgeview Park amphitheatre until 9:30 p.m. every Tuesday evening during the summer months.
4. Consider a request from the Bible Truth Church of God in Christ to reserve the Ridgeview Park amphitheatre and pavilion for the day on August 30, 2008 to hold the “Gospel Idol” event.
5. Second consideration/adoption of an ordinance amending and recodifying Section 98-250.17 of Article II, Division 4, Uses Allowed/Prohibited in Foregoing Districts, of Chapter 98 of the Code of this City to Conform to Revised Planned Unit Development Overlay District Provisions.
6. Second consideration/adoption of an ordinance amending and recodifying Sections 98-250.2, 98-0250.3 and 98-250.10 of Article II, Division 4, Uses Allowed/Prohibited in Foregoing Districts, Of Chapter 98 of the Code of This City to Conform With Article II, Division 6, Overlay Districts, Subdivision I, “Floodplain Overlay District”, of Chapter 98 of the Code of the City ad All Other State and Federal Requirements.
7. Second consideration/adoption of an ordinance appropriating a Reading First Grant in the amount of $11,305 to the Elementary Central Office Fund operating for Fiscal Year Ending June 30, 2008.
8. Second consideration/adoption of an ordinance appropriating a Title IV Drug Free Schools Grant in the amount of $5,603 to the Secondary Central Office Fund Operating for Fiscal Year Ending June 30, 2008.
9. Second consideration/adoption of an ordinance appropriating a Virginia Preschool Initiative in the amount of $70,000 to the Central Office Fund operating for Fiscal Year ending June 30, 2008.
10. Consider a request from New Covenant Motorcycle Ministry to allow amplified music in Constitution Park at the Valley Bike Fest II, on Sunday, September 21, 2008, from 10:00 a.m. until the close of the park.
11. Consider a Supplemental Resolution from the Shenandoah Valley Juvenile Center, authorizing expanded and increased services for the benefit of its members and their citizens.
3. Present a Resolution to Mr. Ed Clark, Director of the Wildlife Center of Virginia, acknowledging their 25th Anniversary and for receiving the prestigious National Wildlife Federation 2007 National Conservation Achievement Award.
4. Planning Matters:
1. Hold a Joint Public Hearing to receive public comment on the request of Acend 2002, LLC, owner, for a Conditional Use Permit for a reduction in required off-street parking from two spaces to zero spaces (a total reduction of four spaces), for single-family homes located at 1108 and 1112 3rd Street, known by Tax Map No. 37-8-1, 2; the zoning designation being RB-3 High Density Dwelling District. Applicant requested this public hearing be “tabled” until April 14.
2. Hold a Joint Public Hearing to receive public comment on the request of Drumeller Properties LLC to rezone a property located at 412 Cedar Avenue and known by Tax Map 44(4), Lots 27, 28 and 29, Block 27, West Waynesboro Land Co., from RB-4 Mixed Density Dwelling District to C-1 Local Business District with proffers.
3. Hold a Joint Public Hearing to receive public comment on the request of James H. and Kay L. Heafner, to amend the City Zoning Ordinance, Code Section 98-250.4B to include Bed and Breakfast Establishment as a permitted conditional use in the RA-3 District Single-Family District.
4. Hold a Joint Public Hearing to receive public comment on the request of James H. and Kay L. Heafner for a conditional use permit to operate a Bed and Breakfast Establishment in the RA-3 Single-Family District at a property located at 607 Oak Avenue, Waynesboro, known by Tax Map No. 44 4 5-4, Block 5, Lots 4, 5, and 6.
5. Hold a Public Hearing to receive public comment on an amendment to the Fiscal Year 2008 Budget in accordance with the Code of Virginia Section 15.2-2507.
6. Consider introducing an ordinance to amend the Fiscal Year 2008 Budget.
7. Presentation by Police Chief Doug Davis and Mr. Greg Hensley from Wayne’s Cycle Shop on the differences between mopeds, scooters and motorcycles in relation to a proposed helmet ordinance.
8. Set a Public Hearing for March 24, 2008 to receive public comment regarding a Deed of Easement to be granted to the Virginia Department of Historic Resources in connection with the renovation of the Wayne Theatre.
9. Presentation of the Transportation Safety Commission’s Annual Report by Robert Johnson, Jr., Chairman of the Commission.
10. Consider adopting a Resolution authorizing the Application to the VDOT Revenue Sharing Program for the Broad Street Bridge Rehabilitation Project.
11. Consider approving a request by Waynesboro Downtown Development, Inc. to close West Main Street from McElroy to Wayne Avenue (Arch and Wayne to remain open) for the Main Street Muscle Car Show, on Saturday, May 17, 2008, from 9:00 a.m. – 5:30 p.m. The request includes the use of amplified music at the event.
12. Consider approving a request of the Virginia Fly Fishing Festival to allow wine tasting and wine sales in Constitution Park on Saturday and Sunday, April 19-20, 2008, from 9:00 A.M. until 5:00 P.M. each day in conjunction with the 8th Annual Virginia Fly Fishing Festival.
13. Consider adopting a Proclamation establishing a Friendly Cities relationship with Wanzhou, China, as requested by Mr. Tom Sykes of Reo Distribution.
14. Citizen Comment Period.
15. Communication, Correspondence and Calendar.
16. Adjourn.
