AGENDA FOR WAYNESBORO CITY COUNCIL REGULAR BUSINESS MEETING TO BE HELD MONDAY, JULY 23, 2007 AT 7:00 P.M. IN THE COUNCIL CHAMBERS, ROOM 104, CHARLES T. YANCEY MUNICIPAL BUILDING, 503 WEST MAIN STREET, WAYNESBORO, VIRGINIA.

1. Call to Order and Pledge of Allegiance.

2. Consent Agenda. (Any item placed on the consent agenda shall be removed and

considered as a separate matter, if so requested by any member of Council. Otherwise, all items will be voted on with one (1) motion.)

1. Second consideration/adoption of an ordinance repealing City Code Section 70-32 “Parades and Processions” and substituting new Sections 70-32.1 through 70-32.10 therefor regarding processes to lawfully conduct parades and other assemblies in the City.

2. Second consideration/adoption of an ordinance amending City Code Section14-46 and adding new Section14-52 therefor regarding control and restraint of dogs and provisions for dog exercise areas in the City.

3. Second consideration/adoption of an ordinance appropriating funds from the Economic Development Authority Reserve Fund to the Economic Development Authority.

4. Consider making an appointment to the Cultural Commission.

3. Planning Matters.

1. Receive a report and recommendation from the Planning Commission concerning a request from Brian Ochs, contract purchaser, for Robert W. Gray Builder, Inc., owner, for a conditional rezoning of property described legally as Tax Map/Parcel 31-1-114A, 7.421 acres located at 625 Lew DeWitt Boulevard , Waynesboro, Virginia from RA-1 (Single Family District) to C-2 (General Business District) for commercial development.

2. Consider a request by Waynesboro TC, LLC for a waiver of Subdivision requirement City Code Sec. 74-40 (e) which requires that each lot shall front on a public street.

3. Consider a request by Duane N, Turner, owner, for a waiver of Subdivision requirement City Code Sec. 74-40 (e) which requires that each lot shall front on a public street.

4. Second Consideration/adoption of an ordinance authorizing the issuance of General Obligation Public Improvements Bonds of the City of Waynesboro, Virginia, in a maximum principal amount not to exceed $26,500,000.00.

5. Consider a resolution providing for the issuance and sale of General Obligation Public Improvement Bonds of the City of Waynesboro, Virginia, in the maximum principal amount of $24,400,000 heretofore authorized, and providing for the form, details and payment thereof.

6. Consider an appointment to the Charter Position of Clerk of City Council.

7. Receive information concerning the Chili Brews ‘n Blues Cook-off event and consider authorizing amplified music, the sale of alcohol on public property, and exclusive use of the Urban Renewal “Advanced” Parking Lot as part of the event.

9. Communication, Correspondence and Calendar.

10. Hold a closed meeting under section 2.2-3711 of the Freedom of Information Act, Code of Virginia 1950, as amended, (a) (3) for discussion or consideration of the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body; specifically for discussion of the disposition of the Waynesboro Health Department property at 1300 13th Street, Waynesboro, Virginia.
