MEDIA RELEASE

PURSUIT AND ARREST OF IAN DANIEL KASDAN, OCTOBER 6, 2008


On October 6, 2008, at approximately 8:30 pm, an officer of the Waynesboro Police Department stopped a 1989 Toyota station wagon on a parking lot adjacent to Poplar Avenue and Broad Street. The officer intended to talk to the driver about a defective brake light and the expired license plates on the vehicle. Upon contact with the driver, later identified as Ian Daniel Kasdan, 26 years-of-age, whose address is listed as 126 West Grattan Street, Harrisonburg, Virginia, the officer asked for a driver’s license and registration which Kasdan allegedly did not provide. Instead, Kasdan allegedly identified himself with a false driver’s license number and, when the first number did not check out, allegedly provided a second false driver’s license number. The officer had also noticed that the car was running but had no key in the ignition switch. The officer attempted to take Kasdan into custody but Kasdan allegedly emerged from his car with a tire iron in his hand and threatened to strike the officer. The officer retreated, drew his pistol and called for additional help from nearby officers. A standoff ensued. During the standoff, Kasdan allegedly told the officer he “was not going back to jail”. As the first backup officer arrived on the scene, Kasdan allegedly retreated to his car and, jumping in, put the car in reverse and struck the police car being driven by the officer who made the initial stop. Kasdan allegedly then sped off with other officers in pursuit.

The pursuit wound its way through several neighborhoods, namely, the Tree Streets, Downtown, Port Republic Road, Wayne Hills and New Hope Road before arriving at the Kate Collins Middle School parking lot. Kasdan allegedly drove onto the lot and around the lot with officers in pursuit. At one point, two officers riding in the same car, Paul Johnson and Dominick Zambrotta, attempted to block the path of Kasdan’s car. Kasdan allegedly rammed their police car in the passenger’s front side, disabling the police car. Kasdan momentarily came to a stop. Kasdan allegedly then accelerated backwards and rammed another police car driven by Officer William Russell being positioned behind Kasdan’s car. Kasdan allegedly then attempted to ram a third car at which time the Patrol Shift Commander gave the order to aggressively stop Kasdan.

After being rammed by Kasdan, Officer Paul Johnson had exited his disabled vehicle and was on foot on the parking lot of Kate Collins School. Kasdan drove to within six to ten feet of Officer Johnson who fired two gunshots from his pistol at the left front tire of Kasdan’s vehicle. The gunshots did not stop Kasdan’s vehicle which exited the Kate Collins School parking lot shortly thereafter.

Kasdan allegedly drove west on Ivy Street followed closely by a Waynesboro officer who used his police car to intentionally bump Kasdan’s vehicle and spin it around in the street as Kasdan approached the intersection of Ivy Street and Hopeman Parkway. Other officers from the Waynesboro PD and Augusta County Sheriff’s Office were able to block the path of Kasdan’s car. Before Kasdan could escape again, Officers and Deputies broke the passenger window and used a TASER to subdue Kasdan and take him into custody.

Kasdan is charged with three felonies arising from his alleged assault of Officers Zambrotta, Johnson and Russell. In addition, Kasdan is charged with felony hit and run and felony attempting to elude police. Also served on Kasdan was an arrest warrant arising out of a probation violation from Harrisonburg/Rockingham County. Kasdan appeared in Waynesboro District Court on October 7, 2008 for a bond and advisement hearing. As a result of that hearing, Kasdan is being held without bond at the Middle River Regional Jail. Detective Corporal Kevin Miller has been assigned as the investigating officer for this incident.

Waynesboro Officer Dominick Zambrotta was injured when his police car was allegedly rammed by Kasdan. Zambrotta was treated and released at Augusta Medical Center for injuries to his ribs. Two other officers sustained minor injuries.

Waynesboro Officer Paul Johnson was uninjured when the police car he was riding in with Zambrotta was rammed by Kasdan. Officer Johnson was placed on paid administrative leave, in accordance with Waynesboro PD policy, following the shooting incident. An internal investigation into the shooting is being conducted by Captain J. W. Oliver, head of Waynesboro PD’s Investigations Division.

GOVERNOR KAINE ANNOUNCES NATIONAL AWARDS FOR VIRGINIA ’S PUBLIC-PRIVATE PARTNERSHIPS IN TRANSPORTATION

RICHMOND – Governor Timothy M. Kaine today announced that the American Road and Transportation Builders Association has honored the Virginia Department of Transportation (VDOT), Secretary of Transportation Pierce R. Homer, and Deputy Secretary of Transportation Barbara W. Reese for their outstanding work on Virginia’s nationally recognized public-private partnerships (P3s). The three honorees were recognized Monday at the ARTBA’s 20th Annual Conference on Public-Private Ventures in Transportation.



“ Virginia is recognized by Forbes.com as the best place to do business in the U.S. and as the best managed state in the U.S. by Governing Magazine,” said Governor Kaine. “I think we can now safely add that Virginia has the best P3 program in the U.S. , thanks to leaders like Secretary Homer and Deputy Secretary Reese, and the hard working men and women of VDOT.”



According to the ARTBA, these three were honored “for their outstanding advocacy and leadership in promoting the ‘practice, use and adoption’ of public-private partnerships on transportation improvement projects.” Since 1995, the Commonwealth’s Public-Private Transportation Act has delivered approximately $9 billion in transportation projects.



“ Virginia has consistently led the P3 revolution in the U.S. and these awards from their peers recognize the Virginia leadership role,” said Jim Weinstein, ARTBA Public-Private Ventures Division Chairman. “ARTBA is proud of the past, present and future work of the Commonwealth in the P3 arena.”



Secretary Homer was the 2008 recipient of the ARTBA Public Sector Entrepreneur of the Year award. During his service as Secretary and Deputy Secretary of Transportation, he has been instrumental in the development of Virginia ’s P3 program, working to ensure competition and accountability.



Deputy Secretary Reese was honored as a “Champion” for her “exemplary work in advancing the practice, use and adoption of P3s in transportation in the United States .” The ARTBA says that Reese has “set the standard” for the implementation of P3s, citing projects such as Dulles Rail, the Capital Beltway HOT Lanes, and the Pocahontas Parkway . Reese’s expertise is a valuable asset to senior-level federal officials, and local and state officials seeking to implement their own P3s.



VDOT was also honored as a “Champion” for its 13 years of commitment to P3s, demonstrated by the dedication of resources to major P3 projects including the Capital Beltway and I-95 HOT Lanes, Pocahontas Parkway in Richmond , Route 28 in Northern Virginia, the Coalfields Expressway in Southwest Virginia , and Route 460 and Midtown Tunnel projects in Hampton Roads. ( Washington , D.C. )—The Virginia Department of Transportation, the Virginia Deputy Secretary of Transportation and the Virginia Secretary of Transportation (VDOT) were honored September 15 for their outstanding advocacy and leadership in promoting the “practice, use and adoption” of public-private partnerships (P3s) on transportation improvement projects. Recipients were recognized at a special dinner during the American Road & Transportation Builders Association’s (ARTBA) 20th Annual Conference on Public-Private Ventures in Transportation, held in the Nation’s Capital.



Among the dozens of worthy public sector organizations and individuals, three were singled out for special recognition.



“Champions”: For exemplary work in advancing the practice, use and adoption of P3s in transportation in the United States.



· Barbara W. Reese, Virginia Deputy Secretary of Transportation, a dedicated public servant and former VDOT Chief Financial Officer has set the standard for negotiating and implementing public sector benefits in P3 projects, including Dulles Rail, Capital Beltway HOT Lanes, and Pocahontas Parkway . Reese is a trusted advisor to senior federal officials and numerous states and localities seeking entry into the P3 arena.



· Virginia Department of Transportation, with 13 years of P3 experience, has dedicated planning, engineering and financial staff resources to critical P3 projects such as the Capital Beltway HOT Lanes, Pocahontas Parkway in Richmond , Rt. 28 in Northern Virginia, Coalfields Expressway in Southwestern Virginia, and other major development projects such as the Rt. 460 and Midtown Tunnel projects in Southeastern Virginia, and the I-95 HOT Lane project in Northern Virginia. The awards program was created to recognize people and organizations who have had made significant contributions to the understanding and application of P3s in transportation.



Established in 1902, ARTBA represents the U.S. transportation construction industry before Congress, the Executive Branch, federal agencies, news media and general public.

Missing Juvenile - October 7

On 09/03/08 the Waynesboro Police Department was contacted by the Department of Social Services to assist with locating a 16 year old missing juvenile who had been placed in their custody. Department of Social Service workers were conducting a routine check on the juvenile who was allowed to stay with his biological sister, 23 year old Melissa Kaye King at a residence in the city of Waynesboro. DSS workers and Waynesboro Police Officers quickly discovered that the 16 year old juvenile, Melissa Kaye King and her 24 year old boyfriend, Samuel Pershing McCauley III, had absconded from the residence and were possibly heading to Florida.

On 09/04/08 warrants were obtained on Melissa King and Samuel McCauley III for abduction under VA Code section 18.2-47. The crime of abduction is a class 5 felony punishable by 1-10 years in prison and a $2500 fine. Melissa King and Samuel McCauley III were entered into the NCIC system as wanted persons. The 16 year old male juvenile was also entered into the NCIC system as a missing juvenile.

During the course of the investigation it was discovered that Melissa King had family in Bay County Florida. Investigators from the Waynesboro Police Department contacted investigators from the Bay County Sheriff’s Office, the Panama City Police Department and the Lynn Haven Police Department and asked for assistance with the investigation. As a result of the entry into the NCIC system, the Waynesboro Police Department was contacted by the U.S. Marshals service. The U.S. Marshals service also offered to assist with the investigation. During the next couple of weeks several leads were investigated by all agencies involved in the search. King and McCauley quickly learned that they were being sought by the Police and subsequently fled the state of Florida.

On 09/26/08 it was discovered that Melissa King, Samuel McCauley III, and the 16 year old juvenile were back in Virginia and they were currently staying at a residence in the 2200 block of Jefferson Highway in Fishersville. Surveillance was subsequently set up on the residence. At approximately 5:30 pm the juvenile was observed walking away from the residence by the surveillance team. Once the juvenile was clear from the residence, the surveillance team took him into custody for being a missing juvenile.


As Deputies from the Augusta County Sheriff’s Office, Officers from the Waynesboro Police Department, and Deputies with the U.S. Marshal’s Service were preparing to execute a search warrant at the residence in Fishersville, the surveillance team observed King and McCauley leaving the residence in a maroon Dodge Durango. The surveillance team followed the suspects until Deputies and Officers were in place to safely take the suspects into custody.

At approximately 6:41pm; all teams were in position and a traffic stop was initiated on Eastbound interstate 64 just outside the city limits of Waynesboro. Both suspects were taken into custody without further incident.

The 16 year old juvenile who was the subject of this investigation was turned over to the Department of Social Services.

The investigation into this matter is ongoing and additional charges may be pending.

APPLE DAY - October 7

Douthat State Park is offering Apple Day on Saturday, Oct. 11, 2008 from 8 a.m. to 6 p.m. at the beach complex representing a celebration of Appalachian Heritage.

Enjoy crisp mountain air and changing leaves and celebrate the fruits of fall. Spend a fun-filled day in the park with apple butter making, traditional Appalachian artisan and craft demonstrations, great food, including a pig roast, and much more.

Enjoy old-fashioned apple butter making beginning at 8 a.m. Stop by with your family to take your turn stirring the kettle. Apple butter will be for sale to take some home and enjoy.

Visit with traditional artisans and crafters as they work from 10 a.m. to 5 p.m. A few of the demonstrations will include basket weaving, blacksmithing, quilting and beekeeping. Some individuals will offer items for sale.

Come watch as Douthat whips up tasty treats over the flame at the Campfire Cookery program from 10 a.m. to 5 p.m. Delicious apple treats will be cooking throughout the day. Sample some of the chef's creations. A small serving is $1 and a large serving in a souvenir mug is $5.

Come and find out why it takes brains to tan a hide. From 10 a.m. to 5 p.m. Douthat will have hides and bones on display. Let Douthat share with you some traditional processes for hide tanning.

Play the part of a child from long ago as you test your skills at some frontier games during Appalachian Antics from 10 a.m. to 5 p.m. Play the games children were playing years ago in the Highlands .

Have you ever wondered how butter is made, how to get the cider from the apple and how you get the corn off the cob? Here is your chance to experience all of this from 10 a.m. to 5 p.m.

Sit back and relax as Douthat's hay wagon is pulled through the cabin area and up the mountain around the lodge as your guide tells you all about the history of Douthat State Park . Hay rides will depart from the lower beach parking area at 11 a.m., 1 p.m. and 3 p.m. and are $3 per person.

District Six Manager Forrest Gladden located at Douthat State Park will be demonstrating techniques used by the Civilian Conservation Corps during the construction of Douthat's facilities from 11 a.m. to 3 p.m. The program will include hand-hewing of logs and shingle making using antique tools.

Bring a lawn chair or blanket and enjoy music and clogging with entertainment throughout the day.

Douthat State Park is also offering guests two special interpretive programs from 10 a.m. to 5 p.m. during Apple Day: Wilderness Survival Adventures featuring Vickie Shufer and The Natural World Through Ancient Eyes featuring Daniel "Firehawk" Abbott.

Vickie Shufer is one of Virginia 's authorities on surviving in nature through the use of native plants for food, shelter, tools and medicinal purposes. You'll be fascinated at the many uses of common plants around you and survival skills you may need to battle Mother Nature.

Learn to build a fire without a match, find "fast food" in the woods, the cure for poison ivy without going to the pharmacy, and so many other fascinating survival skills. In addition to the regularly scheduled public program there will be a special intensive workshop for the first 25 people signed up at the parks.

Take a journey back in time with Daniel "Firehawk" Abbott, a direct descendant of the Nanticoke Tribe of Maryland. You'll be spellbound as you listen and watch live demonstrations of the Native American ways in this dynamic presentation. He'll take you to a time before English settlers arrived and then the interaction upon their arrival to America .

You'll see the art of flint knapping, creation of clothing, types of food and construction of shelters, along with hearing fascinating stories of life amongst the tribes of the Chesapeake Bay area.

Douthat State Park will be providing concessions throughout the day for your convenience. Souvenirs and fun food will be available to purchase.

Armed Robbery - October 7

On 09/30/08 at approximately 9:33pm the Waynesboro Police Department responded to the Texaco Station located at 501 Rife road in reference to an armed robbery. Upon arrival officers were informed that a male suspect, wearing all black clothing, and a black ski mask displayed a silver handgun and demanded money from the store clerk. After receiving an undisclosed amount of money from the clerk the suspect then fled on foot heading North through the alleyway in the 700 block of Chestnut avenue.

Within minutes officers quickly established a perimeter and a Police K-9 began to track the suspect. The Police K-9 continued the track for several blocks through the alleyway but the suspect could not be located.

Nobody was injured as a result of the robbery.
